0844842 B.C. Ltd. v Pinnacle Wealth Brokers Inc.

Cameron Rempel and Jacqueline Houston secured the dismissal of a long-standing claim against our client Pinnacle Wealth Brokers Inc. and its representative for want of prosecution. 

Originally commenced in 2019 by no fewer than 94 individual plaintiffs, the claim raised serious allegations of breach of fiduciary duty and fraudulent misrepresentation and sought millions of dollars in damages. The plaintiffs had done nothing to advance their claims (and to allow Pinnacle the opportunity to respond and vindicate itself) since 2023. 

Associate Justice Robinson of the Supreme Court of British Columbia was satisfied that the plaintiffs had failed to pursue their claims with “any semblance of diligence”, without tenable excuse, and thus concluded it was not in the interests of justice for the action to proceed. On September 9, 2026, the court dismissed the plaintiffs’ appeal of the decision.
