AGB at the SCC with Ecojustice to ensure that clarification of Ontario's anti-SLAPP regime protects environmental speech
AGB lawyers, Robert Stellick and Ana Qarri, appeared at the Supreme Court of Canada today on behalf of the intervener, Ecojustice Society Canada, on a significant defamation law appeal engaging the application of Ontario's statutory anti-SLAPP regime. Robert and Ana appeared alongside Ecojustice lawyer, Kegan Pepper-Smith.
In Prescott, et al. v. Benchwood Builders Inc., et al., SCC Court File No. 41794 (on appeal from 2025 ONCA 171), the Supreme Court will decide how Ontario’s anti-SLAPP regime treats online consumer reviews. Ecojustice intervened to advocate that, in interpreting and applying the statutory regime, the Supreme Court ought to protect online speech. In particular, the Court ought to consider the right of conscientious consumers to speak up about harmful corporate environmental practices without fear of facing strategic and silencing defamation claims.
