Geoff Adair acted for Onex Corporation in this hard fought directors and officers liability insurance case, recovering trial judgment against American Home Assurance Co. for $15 million USD (the full policy limits), and then successfully defending the trial judgment on appeal. The appeal followed protracted litigation, including a summary judgment motion, trial, two appeals to the Court of Appeal for Ontario, and two applications for leave to appeal to the Supreme Court of Canada.
