Torstar Corporation v. Meta Platforms, Inc.
Jordan Goldblatt, Alex Fidler-Wener, and Emily Vaillancourt are counsel for Torstar Corporation (owner of the Toronto Star and other news publications) in its application against Meta Platforms, Inc. for breach of contract.
Our lawyers successfully opposed Meta's motion for a permanent stay, challenging the Ontario Superior Court of Justice's jurisdiction pursuant to a forum selection clause that Meta unsuccessfully claimed required the litigation to proceed in California, applying California law. This motion raised important questions about - and ultimately, placed significant limits on - the breadth and applicability of the choice of forum clauses in Meta's online Terms of Service and Commercial Terms.
With Meta's jurisdictional arguments defeated, Torstar's application will now proceed on its merits.
