Rudanycz v. Rudanycz

John Adair, Jocelyn Howell and Rachel Allen successfully defended a challenge to a Testatrix’s Last Will and Testament (the “Will”) by two of the Testatrix’s sons on the grounds of lack of knowledge and approval, lack of testamentary capacity and undue influence. AGB represented the named Estate Trustee and propounder of the Will. Following a two-week trial, the Court dismissed the challenge in its entirety and upheld the Will as valid, finding that the Testatrix knew and approved of the Will, had testamentary capacity at the relevant times, and rejecting that the Will resulted from due influence.
