Robert Trenker, retained as appellate counsel, successfully obtained an order from the Court of Appeal for Ontario overturning a civil jury verdict and and directing a new trial on the basis that the trial was unfair; difficult to obtain, rarely granted relief. The judicial standard for achieving such a result is high: only where "some substantial wrong or miscarriage of justice has occurred" and only "where the interests of justice plainly require a new trial".
