Cogeco Communications Inc. et al. v. Bell Canada et al.; Cogeco Communications Inc. et al. v. Attorney General of Canada

Simon Bieber, Joey Howell, and Emily Vaillancourt represent Saskatchewan Telecommunications ("SaskTel") in two related proceedings regarding the provision of wholesale access to telecommunications fibre networks.

The first is a judicial review application in Federal Court for review of a Governor in Council decision, and the second an appeal to the Federal Court of Appeal from a decision of the Canadian Radio-television and Telecommunications Commission (the "CRTC"). Both involve challenges related to CRTC Telecom Regulatory Policy 2024-180, which directed SaskTel, among other telecom companies, to provide competitor Internet providers with workable wholesale access to their fibre networks.

This Policy, if upheld, would significantly impact the viability of SaskTel, a Crown corporation that operates with a public policy mandate and has invested substantially in providing reliable, high-speed internet to the residents of Saskatchewan. These cases therefore have significant implications for the regulation of Canada’s telecommunications industry. They also raise questions about the limits of the CRTC’s jurisdiction and the balancing of the CRTC’s competing policy objectives.
