Gord McGuire successfully represented the City of Thunder Bay in this insurance coverage application, obtaining a declaration that the respondent insurance company's policy imposed on it a duty to defend the City in four law suits, including a class action, commenced against it by residents and local stakeholders in relation to alleged leaking pipes. This case is of significant precedential value, being the first in Canada to interpret a “lead exclusion” coverage clause in a comprehensive general liability insurance policy.
