Retained as appeal counsel, Robert Trenker acted successfully for the appellant in this important decision providing long-overdue clarity on the scope of a municipality’s liability for its highways under section 44 of the Municipal Act, 2001, ultimately obtaining an order reinstating the plaintiff’s negligence action against the City of Hamilton. Ana Qarri assisted with the response to the respondent's application for leave to appeal to the Supreme Court of Canada, which was dismissed with costs.
