Retained as appeal counsel, Robert Trenker acted successfully for the appellant in this important decision providing long-overdue clarity on the scope of a municipality’s liability for its highways under section 44 of the Municipal Act, 2001, ultimately obtaining an order reinstating the plaintiff’s negligence action against the City of Hamilton.
