Baker v. Blue Cross Life Insurance Company of Canada (ONSC)
Geoff Adair successfully represented the plaintiff in this five-week jury trial, in which the defendant disability insurance company was found to have wrongfully denied and mishandled her claim for long-term disability benefits. The jury awarded our client a record-breaking punitive damages award of $1.5 million, the largest ever awarded against an insurer in Canada. The Court further made the extraordinary, and rarely granted ruling of requiring the defendant insurance company to pay our client's legal costs on a full indemnity basis, amounting to over $1 million.
