Amato v. Welsh

Alex Fidler-Wener, acting with a former colleague at her prior firm, successfully defended the plaintiff's motion for summary judgment in this solicitor's negligence case, obtaining summary judgment in favour the defendant law firm. Applying both vicarious liability and agency principles, the Court held that the law firm firm was not liable for the alleged acts and omissions or negligence of a co-defendant lawyer who had been in a counsel relationship with the law firm at the time of the alleged wrongdoing.
