Alex Fidler-Wener, acting as trial counsel with a former colleague at her prior firm, successfully defended a third-party action against lawyers in relation to a failed real estate transaction. The plaintiff purchaser sued defendant vendors for specific performance. The defendant vendors argued that any liability was their lawyers' fault and sought indemnity for any loss they may suffer as a result of the action. The trial judge granted the plaintiff's claim and ordered specific performance to complete the transaction, yet denied the defendant vendors' third party claim against their ' lawyers.
