After hard-fought preliminary applications relating to the authenticity of a whistleblower letter, AGB partners Simon Bieber and Chris Grisdale obtained leave for a shareholder to commence a derivative action on behalf of a publicly traded company against its former CEO, in Eastern Platinum Limited v. Ren, 2023 BCSC 706.

On March 21, 2024, the British Columbia Court of Appeal released its judgment on the company's appeal from that decision, reported at 2024 BCCA 109. Chris and Simon successfully defended the appeal, preserving the shareholder's right to commence a derivative action pursuing claims on the company's behalf against the former CEO.
