Jordan Goldblatt and Jackie Houston were successful on this 'boomerang' summary judgment motion. Our firm's clients were purchasers that defaulted on an agreement of purchase and sale for a pre-construction home. The vendors did not ultimately build the home and sued for damages, and then moved for summary judgment within that action. Jordan and Jackie were not only successful in striking the vendor's expert evidence and opposing the vendor's requested adjournment to file better evidence, but in ultimately obtaining summary judgment in the purchaser's favour on the basis that the vendor had neglected to prove any damages.
